These Terms and Conditions govern the use of our website www.raimsas.com (hereinafter referred to as the "Site"), including all services provided through the Site.

3. Acceptance of Terms

By accessing, browsing, or using the Site in any way, the user agrees to be bound by these Terms and Conditions, including the policies and guidelines referenced herein. If you do not agree to all the terms and conditions, please do not use the Site.

4. Changes to Terms and Conditions

RAIM reserves the right to modify, add, or remove portions of these Terms and Conditions at any time and at its sole discretion. It is the user's responsibility to check these Terms and Conditions periodically for changes. Continued use of the Site following the posting of changes will mean that the user accepts and agrees to the changes.

5. Registration and Account

To make purchases on the Site, it is necessary to create a user account. The user is responsible for maintaining the confidentiality of their account information, including the password, and for all activities that occur under their account. The user agrees to immediately notify RAIM of any unauthorized use of their account or any other breach of security.

6. Products and Services Offered

RAIM offers a wide range of spare parts and equipment for agriculture and gardening. All descriptions, images, references, features, contents, specifications, products, and prices of products and services described or depicted on the Site are subject to change at any time without notice and are derived from information published by the manufacturers of the goods included in our catalog. RAIM is committed to ensuring that all information is accurate and up-to-date, but does not warrant that product descriptions or other content of the Site are accurate, complete, reliable, current, or error-free.

7. Return and Replacement Policy

7.1 Right of Withdrawal for Private Consumers

If the customer is a consumer (i.e., a natural person who purchases the goods for purposes not related to their professional activity and without indicating a VAT number), they have the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, within 14 calendar days from the date of receipt of the products.

7.2 Methods for Exercising the Right of Withdrawal and Quick Access

To exercise the right of withdrawal within the required 14 days, the Private Consumer has the following simplified procedures available:
A. Via Account: By accessing their private area, in the order history section, a specific withdrawal button is available next to the order placed. This button will be disabled or no longer visible once 14 days from delivery have elapsed.
B. Via Public Link in the Footer: By clicking on the "Shipping, Deliveries and Quick Return Procedure" link located in the footer (bottom of the page) of the Site.
C. Via Quick Form: By clicking directly on the quick verification button provided in the box below.

As an alternative to the automatic options, it is always possible to send an explicit communication via email to raim@raimsas.com including the order number and details of the purchased product.

7.3 Effects of Withdrawal

In the event of withdrawal, RAIM will reimburse all payments received from the customer, including delivery costs (with the exception of supplementary costs resulting from the choice of a type of delivery other than the least expensive type of standard delivery offered by RAIM), without undue delay and in any case no later than 14 days from the day on which RAIM was informed of the customer's decision to withdraw from the contract. RAIM will carry out such reimbursement using the same means of payment used by the customer for the initial transaction.

7.4 Return of Products and Transport

The customer is required to return the products to RAIM without undue delay and in any case within 7 working days from the date the request was opened on the website, otherwise the case will be officially canceled due to warehouse logistical requirements.
N.B. Please note that the costs and organization of transport for returning the products are entirely the responsibility of the customer. The shipment must be sent to the following address: R.a.i.m. s.a.s., Via Giuseppe Laterza, 39, 88900 CROTONE (KR), Italy.

7.5 Returns and Replacements for Professional Customers and Companies (B2B)

The right of withdrawal for change of mind is exclusively reserved for Private Consumers. For professional customers or companies purchasing by entering their VAT number, any returns due to incorrect ordering are subject to the sole discretion and approval of RAIM. In the case of products ordered explicitly at the customer's request and not available in stock, if a return is exceptionally accepted, RAIM will apply a restocking fee varying from 10 to 30 percent of the product's value, based on the provisions and deductions applied by the original manufacturer. In any case, the goods must be returned intact, in their original packaging, and without signs of wear.

7.6 Product Conditions and Anti-Fraud Protection

The customer is liable for any diminished value of the goods resulting from handling other than what is strictly necessary to establish the nature, characteristics, and functioning of the goods. If the returned product shows signs of wear, dirt, or damage resulting from the actual use of the equipment, RAIM will deduct an amount proportional to the commercial depreciation of the asset from the refund.
All shipped machinery and equipment are strictly tracked via serial or registration numbers recorded in our systems prior to shipment. In the event of withdrawal, the serial number of the returned product must match exactly the one shipped. Returns of items with different serial numbers will be immediately rejected, blocking any form of refund, and the matter will be reported to the competent authorities for suspected fraud.

7.7 Exclusions and Limitations

For Professional and Corporate customers, returns or replacements of items expressly ordered from the manufacturer and not available in ready stock are not accepted under any circumstances, unless explicitly authorized by the parent company and subject to the deduction of penalties. For Private Consumers, the return is not applicable exclusively to goods provided by law, such as custom-made or clearly personalized items. In no case will return requests be accepted beyond 14 days from the date of receipt.

8. Orders and Payments

All orders placed through the Site are subject to acceptance by RAIM. RAIM reserves the right to refuse or cancel any order for any reason, including, but not limited to, product availability, errors in product descriptions or prices, or errors in the order. In case of cancellation of an order, RAIM will promptly refund the full amount paid.

9. Order Cancellation

The customer may request the cancellation of the order before it has been shipped by contacting customer service via email at raim@raimsas.com. If the order is canceled before shipment, RAIM will refund the full amount paid by the customer.
Attention: for Professional and Corporate customers (VAT number) only, the option to cancel the order is precluded if the goods were explicitly ordered by RAIM from its supplier (products not marked as READY DELIVERY) and the latter has not accepted the cancellation.

10. Prices

All prices indicated on the Site are expressed in Euros and include VAT (where applicable) but do not include shipping costs, which will be added to the total amount due and calculated based on the weight of the products in the shopping cart. Shipping costs may vary depending on the delivery method or courier chosen. RAIM reserves the right to change prices at any time, but products will be invoiced on the basis of the prices indicated on the Site at the time the order is placed.

11. Warranties

All products sold by RAIM to private consumers are covered by the legal guarantee of conformity provided for by articles 128-135 of the Italian Consumer Code (24 months). For purchases made by professionals or companies with a VAT number, the warranty is 12 months as provided for by the Italian Civil Code. To benefit from assistance, the customer must keep the invoice or receipt.

12. Limitation of Liability

To the maximum extent permitted by applicable law, RAIM shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use of or inability to use the Site or the services offered.

13. Processing of Personal Data

15. Disputes

For any dispute that may arise, the Court of Crotone shall have exclusive jurisdiction.
